An Advisory Opinion is requested as to whether it would be appropriate for a judge to serve as a Trustee of the Rockdale County Retirement Fund, a retirement fund for the benefit of county employees.

The judge states that, as a county employee, he is a member of the retirement system, and the total number of Trustees is five (5). He represents that he foresees no litigation involving this fund coming before his State Court.

On the basis of these representations, the Commission has concluded that it would not be inappropriate for the judge to serve as a Trustee of this fund subject to the limitations set out in Rule 3.7(B).
