Opinion 111

The Commission has been asked for an Advisory Opinion as to whether the appointment of a retired Senior Superior Court Judge as Judge of a Municipal Court would constitute a violation of the Code of Judicial Conduct.

In the opinion of the Commission, such an appointment would not constitute a violation of the Code of Judicial Conduct or present any ethical problem but, in view of the provisions of O.C.G.A. § 47-8-66, the acceptance of the appointment might result in the suspension of the Senior Judge from that position while holding the office of Municipal Court Judge.
